Leave of Absence during term time

January 2017

Please be aware that despite conflicting judgments throughout the country, Bristol City Council are issuing Penalty Notices for unauthorised absences of 4 days and more. If you want to request leave during term time, please come into the office for a leave of absence form or download one from the link on the opposite page.

Amendments to the 2006 regulations of the Education (Pupil Registration) (England) from September 2013 removes the threshold of ten days discretionary holiday granted by Headteachers.

The law as dictated by the Department for Education, does not give any entitlement to parents or carers to request a leave of absence during term time. Any application, for leave of any type, must only be for exceptional circumstances and the Headteacher must be satisfied that the circumstances warrant the granting of leave. Holiday will never qualify. Leave of absence will not be granted for the first two weeks of the school year or during SATs week in May.

A leave of absence form MUST be completed and submitted prior to any arrangements being finalised and handed in to the office no less than 10 school days before the absence would commence. Parents can be fined for taking their child on holiday during term time without consent from the school. Current fines are £60 per parent/carer for each child, increasing to £120 if not paid within 28 days.

Each application will be assessed on an individual basis, considering both the impact missing school will have on your child’s education and any circumstances of which you make us aware. Appropriate evidence such as a medical certificate may be requested .School will consider the explanation for the request for leave of absence and take into account

*           The exceptional circumstances of the request

*           The pupil’s absence/ attendance record and absence patterns

*           The length of the proposed leave

*           The pupil’s ability to catch up the work missed

*           The pupil’s educational needs

*           The general welfare of the pupil

*           Previous requests

If agreement for leave of absence is given, code “C “will be shown on the child’s attendance record and this will be counted as authorised absence for that period.

If a parent/ carer takes their child without permission being granted by school, this will count as unauthorised absence and will show as a code “G”. More than 8 sessions (4 Days) unauthorised absence may lead to a penalty notice being served. Bristol City Council’s Education Welfare Service monitor children’s attendance independently and scrutinize records.

We understand that some parents have no choice about when to take holidays, however the law requires attendance at school and many parents are not aware that it is not a parental right to take children out of school at term time.

Every day counts and any absence from school will result in lost learning and a risk of falling behind.

There are 13 weeks of the year when the school is closed
